Exemptions

• Exclusions include:
  • Consumer Products
  • Cosmetics and Prescription Drugs
  • Explosives
  • Pesticides
  • Nuclear Substances
  • Hazardous Waste
  • Wood or Wood Products
  • Tobacco and Tobacco Products

• These products are covered by other legislation
  • example the Pesticides Act, R.S.O. 1990, c. P.11 for Ontario

NOTE: While these products may be exempt from having a WHMIS label and SDS, buyers/users of these products must comply with all labelling requirements prescribed within the above acts and regulations. Furthermore, employers are still responsible for providing education and training on health effects, safe use, and storage of these products.

• Training still must be delivered on these products
• SDS’s should still be provided if available
